Terms of Service

By creating an account, accessing, or using EventPing (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and EventPing.

EventPing provides a push notification delivery platform that allows developers to send real-time notifications to Apple devices (iPhone, iPad, Mac) via a RESTful API. The Service includes the EventPing website, API, dashboard, and client applications.

• You must provide accurate and complete registration information.
• You are solely responsible for maintaining the confidentiality of your account credentials and API keys.
• You are responsible for all activity that occurs under your account.
• You must be at least 16 years of age to create an account.
• One person or entity may not maintain more than one free account.

4.1 Billing

• Paid plans are billed in advance on a monthly recurring basis.
• All fees are quoted in US Dollars (USD) and are exclusive of applicable taxes.
• Payment is processed securely through Stripe. You authorize us to charge your payment method on file for all applicable fees.

4.2 No Refunds — Strictly Enforced

4.3 Plan Changes & Cancellation

• You may upgrade or downgrade your plan at any time through the dashboard.
• Downgrades take effect at the end of the current billing period. Excess resources (devices, API keys) may be deactivated automatically.
• Cancellation stops future billing but does not entitle you to a refund for the current or any prior billing period.

4.4 Overage Charges

If your plan includes overage billing, notifications exceeding your plan's monthly quota will be charged at the applicable per-notification overage rate. Overage charges are non-refundable.

You agree NOT to use the Service to:

• Send spam, unsolicited messages, or bulk advertising.
• Transmit malicious, harmful, threatening, abusive, defamatory, or illegal content.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to gain unauthorized access to the Service, other accounts, or related systems.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
• Use the Service in any way that violates applicable laws or regulations.
• Resell, redistribute, or sublicense access to the Service without written permission.
• Send notifications containing malware, phishing links, or deceptive content.
• Use the Service to circumvent Apple's guidelines or APNs terms.

• API usage is subject to the limits of your subscription plan.
• We reserve the right to throttle or suspend API access if usage patterns indicate abuse, excessive load, or violations of these Terms.
• API keys are confidential. You are responsible for any usage associated with your keys. Compromised keys should be revoked immediately.

The Service, including its original content, features, and functionality, is owned by EventPing and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of content you transmit through the Service (notification payloads), but grant us a limited license to process and deliver that content as part of the Service.

• We do not guarantee that notification delivery will be instantaneous, uninterrupted, or error-free.
• Push notification delivery depends on Apple's APNs infrastructure, which is outside our control.
• We may perform scheduled or emergency maintenance that temporarily affects availability.
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

You agree to indemnify, defend, and hold harmless EventPing and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) the content of notifications you send through the Service.

• You may close your account at any time through the dashboard or by contacting support.
• We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.
• Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.
• Termination does not entitle you to any refund of fees already paid.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Ontario, Canada. You irrevocably submit to the exclusive jurisdiction of such courts.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EventPing regarding the Service and supersede all prior agreements, representations, and understandings.

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service.
